These Terms of Use (“Terms”) govern your access to and use of this Website, as well as your use or purchase of any services, programs, products and offerings provided by Mindful Fig Wellbeing Inc. (“Company,” “we,” “us,” or “our”), including but not limited to the Somatic Calm Year™, Week of Somatic Calm™, Somatic Calm Reframe Method™, private sessions, virtual sessions, in-person sessions, group sessions, workshops, courses, digital materials, email-delivered programs, and related offerings (collectively, the “Services”).
By accessing the Website, purchasing, or using the Services, you agree to these Terms.
1. Eligibility
You represent that you are at least the age of majority in your jurisdiction, or otherwise legally authorized to use the Services.
2. Nature of Services
The Services are educational and complementary wellness and personal development offerings intended to support self-reflection and personal growth.
The Services do not constitute medical, psychological, psychiatric, or therapeutic care and are subject to our Disclaimer.
Some Services are delivered over time, including daily or weekly email-delivered programs, rather than all at once.
Participation in the Services is voluntary and users assume responsibility for their own decisions and well-being
3. Program Delivery
Email-based programs are scheduled according to Pacific Time (Canada) unless otherwise stated.
Delivery timing may vary based on participant time zones, email providers, or technical factors.
We do not guarantee exact delivery times.
4. Payments
Fees for Services are listed at the point of purchase and may change without notice.
Payments may be processed through third-party payment providers including Stripe and PayPal. By making a purchase, you agree to their applicable terms and privacy policies.
Applicable taxes may apply.
Failure of payment may result in suspension or termination of access.
5. Purchases and Refund Policy
Due to the nature of the Services and staged delivery of program content over time, purchases are non-refundable.
All purchases are final once a program has commenced, unless otherwise expressly stated at the point of purchase.
A program is deemed commenced when the introductory email for the program has been sent.
Any exceptions must be expressly made in writing by Mindful Fig Wellbeing Inc.
6. Sessions, Scheduling and Cancellations
Private sessions may be rescheduled with at least 24 hours notice.
Missed appointments or cancellations made without required notice may be forfeited.
Session fees are non-refundable once booked unless otherwise stated.
7. Personal Use License
Subject to these Terms, we grant you a limited, personal, non-transferable, revocable license to use the Services for your individual, non-commercial use only.
Purchases may not be shared, transferred, copied, or distributed.
8. Intellectual Property
All content associated with the Services, including text, prompts, materials, methods, graphics, recordings, frameworks and related materials are the intellectual property of Mindful Fig Wellbeing Inc.
Somatic Calm Year™, Week of Somatic Calm™, and Somatic Calm Reframe Method™ are proprietary works and may not be copied, reproduced, shared, distributed, taught from, or used commercially without prior written permission.
All rights reserved.
No part of the Services may be copied, adapted, republished, or used to create derivative works without prior written consent.
9. User Conduct
You agree not to:
Share paid access with others
Reproduce or distribute materials without permission
Misuse or interfere with the Website or Services
